1. Acceptance of Terms

By downloading, installing, or using the Histou mobile application ("App") or accessing the Histou website at histou.com ("Website"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Service

Histou is an AI-powered educational platform that allows users to interact with representations of historical figures. Our services include:

• AI text-based conversations with historical figures
• AI voice conversations with historical figures
• Cinematic audio biographies and narrated stories
• Interactive quizzes — factual knowledge and historical decision scenarios
• Curated quotes, affirmations, reflections, and prayers
• Personalized learning paths with progression and streaks

3. AI-Generated Content Disclaimer

Histou uses artificial intelligence to generate conversations, voice responses, and other content. You acknowledge and agree that:

• AI-generated conversations are simulated and do not represent the actual views, opinions, or words of any historical figure.
• While we strive for historical accuracy, AI-generated content may contain inaccuracies, anachronisms, or creative interpretations.
• Content should be used for educational and entertainment purposes and should not be relied upon as the sole source of historical fact.
• Voice simulations are AI-generated and do not use actual recordings of historical figures.
• Histou does not sanitize history. Content may include uncomfortable truths and complex portrayals of historical figures as they were.

4. User Accounts

To access certain features, you must create an account. You may register using your email address or through third-party sign-in providers. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and up-to-date information
• Notifying us immediately of any unauthorized use of your account

You must be at least 13 years of age to create an account and use Histou.

5. Subscriptions and Billing

Histou offers both free and premium subscription tiers:

• Free tier: Access to core features with limited daily interactions and advertisements.
• Basic tier: Unlimited AI text chats, full audio biography library, complete quiz collection, ad-free experience, and voice conversations.
• Pro tier: Everything in Basic plus extended voice conversation limits and the full premium experience.

Subscriptions are processed through the Apple App Store. Payment is charged to your app store account upon confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your app store account settings.

6. Acceptable Use

You agree not to:

• Use Histou for any unlawful purpose or in violation of any applicable laws
• Attempt to manipulate AI systems to generate harmful, hateful, or inappropriate content
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Use automated systems or bots to access the service
• Interfere with or disrupt the integrity or performance of the service
• Share your account credentials with others or allow multiple users on a single account

7. Intellectual Property

All content, features, and functionality of Histou — including but not limited to text, graphics, logos, icons, audio, software, and the underlying AI models — are owned by Histou and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of our service without express written permission.

8. User Content

Messages you send during conversations with AI historical figures are processed to generate responses and may be stored to improve your experience. You retain ownership of any original content you create. By using the service, you grant Histou a non-exclusive, worldwide license to process your inputs for the purpose of providing and improving the service.

9. Disclaimer of Warranties

Histou is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, error-free, or free of harmful components. We make no warranties regarding the accuracy, reliability, or completeness of any AI-generated content.

10. Limitation of Liability

To the maximum extent permitted by law, Histou and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the service, whether based on contract, tort, or any other legal theory.

11. Termination

We reserve the right to suspend or terminate your access to Histou at our sole discretion, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the service ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes through the App or via email. Your continued use of Histou after changes are posted constitutes acceptance of the updated Terms.
